(2) I am curious that there seems no comment that I have yet seen/heard on this from the political left. This is, after all, about employers wanting to suppress their employees’ workplace expressions of faith, and usually the left (I speak broadly) has been quite quick to point to employer (ab-)use of their position of power. If the Unfair Contract Terms Act protects consumers from trader abuse of their superior knowledge/resources/etc, why not a similar approach in employment law ? And if there are such rules – I leave that to the employment lawyers – might they be of some use here, either directly or as an inspiration for the ECHR’s eventual judgement … ?
